You start on 85% — five points above the market median. The split moves to 90% automatically after three payouts and to 95% after six. There is nothing to negotiate and no application to file.

Yes, and the caps are published up front: payout #1 is capped at 3% of the account, #2 at 5% and #3 at 7%, each also capped at $10,000. From payout #4 there is no cap. Eligible unpaid profit is carried forward, never confiscated.
